Terms and Conditions
These terms explain the basis on which our digital guides and related products are sold and may be used.
About These Terms
These Terms and Conditions apply to digital guides, ebooks, downloads, courses, templates and related materials sold by Simon From Scotland (referred to as “we”, “us” or “our”), including products purchased through a sales page operated by us and paid for or delivered through JVZoo.
By placing an order, you confirm that you have read and accepted these terms. If you do not agree, please do not purchase or use the product.
Digital Products and Delivery
Our products are supplied digitally; no physical item will be posted unless the sales page clearly says otherwise. Access or download instructions are normally provided after successful payment through the checkout or delivery platform.
You are responsible for providing an accurate email address, maintaining access to your account and using a compatible device and software. If you experience a genuine delivery or access problem, contact us so we can try to help.
Prices and Payment
The price displayed at checkout is the price payable for the product, subject to any taxes, currency conversion or other charges clearly shown by the payment provider. Payment processing, order records and certain refund functions are handled by JVZoo under its own terms and privacy practices.
We may change prices or withdraw offers at any time, but this will not alter an order already accepted.
Refunds and Cancellation Rights
Unless a sales page states a longer period, we offer a voluntary seven-day refund period from the date of purchase. Refund requests should be made through the support or refund process shown with your order, or by contacting us directly.
Because these products are digital, immediate access may affect a consumer’s statutory right to cancel once downloading or streaming begins where the purchaser has expressly consented to immediate supply and acknowledged the effect on that cancellation right.
Nothing in these terms excludes or limits rights that cannot legally be excluded, including rights relating to digital content that is faulty, not as described or not supplied with reasonable care and skill. The phrase “all sales are final” does not override applicable statutory rights.
Requests made after the stated voluntary refund period may be considered where there are exceptional circumstances, without creating an obligation to approve them.
Licence and Permitted Use
When you purchase a product, you receive a limited, non-exclusive, non-transferable licence to access and use it for your own personal use, unless a separate licence clearly grants additional rights.
You must not:
- copy, reproduce, share, upload or distribute the product or a substantial part of it;
- resell, sublicense, rent, lend or give the product to another person;
- remove copyright notices, branding or ownership information;
- claim the content as your own or use it to create a substantially similar competing product; or
- use the product for any unlawful, fraudulent or harmful purpose.
Intellectual Property
Unless otherwise stated, all original text, layouts, graphics, templates and other materials in our products and sales pages are owned by or licensed to us and are protected by applicable intellectual-property laws. References to third-party websites, services and trademarks remain the property of their respective owners and do not imply endorsement.
Educational Information and No Guarantees
Our products provide general educational information only. They do not constitute financial, legal, tax, employment, medical or other professional advice. You should obtain appropriate professional advice where necessary.
We do not promise or guarantee employment, clients, earnings, savings, business growth or any other particular result. Outcomes depend on many factors outside our control, including your decisions, effort, experience, location, market conditions and third-party rules.
Third-Party Websites and Services
Our products may mention or link to third-party websites, platforms, tools or offers. These are provided for information and convenience. We do not control and are not responsible for their availability, security, content, prices, terms, privacy practices or performance.
Websites and services change over time. You should verify current information and use your own judgement before registering, sharing personal information, paying a fee or relying on a third-party service. Some links may be affiliate links; where required, this will be disclosed.
Acceptable Conduct
You must not attempt to gain unauthorised access to our pages, delivery systems or accounts; interfere with their operation; introduce malicious code; misuse support services; or use our materials in a way that infringes another person’s rights.
Availability and Changes
We aim to keep our products accessible and accurate, but uninterrupted availability is not guaranteed. We may correct errors, update content, replace delivery methods or make reasonable changes where necessary. If a purchased product cannot be supplied, we will provide an appropriate remedy as required by law.
Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.
Subject to the paragraph above, we are not responsible for losses that were not reasonably foreseeable when the contract was made, losses caused by circumstances outside our reasonable control, or business losses arising from a consumer purchase. You remain responsible for how you use the information and for keeping suitable backups and security protections.
Privacy
Personal information is handled in accordance with our Privacy Policy. Payment and delivery providers, including JVZoo, may process information under their own privacy policies.
Governing Law
These terms are governed by the laws of Scotland. The Scottish courts will have non-exclusive jurisdiction, which means that a consumer may also be entitled to bring a claim in the courts of the part of the United Kingdom in which they live. If you live outside the United Kingdom, mandatory consumer protections in your country may also apply.
Changes to These Terms
We may update these terms from time to time. The date at the top shows when they were last revised. The terms in effect when your order was placed will normally apply to that purchase, except where a change is required by law.
